Today we hardly can imagine the structure of the U.S. judicial branch of power without a link with the U.S. Attorney General post. In 1789 the Congress act (the First Congress in the Judiciary Act) actually created the office of the U.S. Attorney General. But at that time nobody could predict that the position of the Attorney General would become so important for all judicial system, because attorneys were engaged on a part-time schedule and were paid scarce salaries. The Attorney General had only two main responsibilities: 

1) handling all the legal procedures and seeking penalties, which were connected with federal or state law, in the Supreme Court;

2) counseling the leaders of the USA executive branch of power on legal questions.

 The work in court took not so much time as nowadays, because a small number of suits were brought to court. For example, Charles Lee, Edmund Randolph, and William Bradford, who were the first attorneys on post of the U. S. Attorney General, had prosecuted no more than six legal cases for the period of their holding the office.

Moreover the act of 1789 limited the authority of the Attorney General to prosecute cases outside courtyard of the U.S. Supreme Court. Suits in district courts were conducted by state attorneys (or district attorneys). The resolution of the suitcase depended directly on the opinion of the attorney; as a result, a lot of disputable points of view related to the cases had been produced. The Attorney General could not influence state attorney, so he couldn’t control any of prosecutions. 

The first Attorney General to discuss the problem of power restrictions was the attorney Randolph, he also for the first time made a proposal to enlarge the privileges of the Attorney General in his letter to George Washington. Nevertheless, Congress did not intend to adopt acts which would give the Attorney General more legal power.
